58 Children Rescued from Zari Industry

7 February 2008, New Delhi – Under the India Action Week against trafficking of children for forced labour, Bachpan Bachao Andolan (BBA) conducted third raid in Delhi along with the labour department and police and rescued 58 bonded child labourers.

Mirza (name changed) was brought to Delhi by a person whom he had often seen coming to village and would take some children with him in a bus. He didn't realize that one day he would also be going with this man and end up in Delhi. He along with 57 others were rescued from Khumara Mohalla, Old North Ghonda in the New Usmanpura police station premises.  He also told to the activists that the trafficker gave his father Rs 700 and his father agreed to send Mirza to Delhi. Mirza used to work from 10 AM to 1:00 AM in the night and was given Rs 20 / week and this money was added to the 'expenses' incurred by the employer on the children.

The room in which they were working was just in the middle of cattle shed, so that nobody could know that there was a manufacturing unit. In one room there were 10 people working including adults and children.  Their working area and sleeping area was the same, with no source of ventilation, the smell of cattle dung all around and filthy rooms. Most of the children hadn't even had a bath for days, they had a dry itchy skin and some were also showing the signs of bacterial infections on their tender skins

The Sub-Divisional Magistrate, Shri L. R. Meena said that this raid was conducted on the basis of the complaint filed by BBA. The case is registered under the Child Labour (Prohibition and Regulation) Act 1986 and Bonded Labour System (Abolition) Act 1976. Assistant Labour Commissioner Shri M. S Yadav told that case will also be filled on the owner of the house in which these illegal manufacturing units were running.
The rescued  children were trafficked from Sitamarhi and Dharbhanga district  and these are the core area where traffickers are taking advantage of the poor condition of the parents and bringing children said Rakesh Senger, National Secretary of BBA,. He also said that BBA would write to the Police Commissioners of Sitamarhi and Dharbhanga districts to take action on this issue.

Prof. R. S Chaurasia, Chairperson BBA who led this raid said that in Indian Action week BBA team was able to rescue over 500 bonded child labourers from different states   within seven days-over 130 children were rescued from Delhi alone.

5 February 2008 – Little would women buying from high-end fashion streets and expensive showrooms and shops in India and abroad realise that the fancy bangles, shoes, belts and those eye-catching wallets are made by the injured and tiny hands of little trafficked and enslaved children. Today 82 such children were rescued in two different raids jointly conducted by Bachpan Bachao Andolan (BBA) in association with Sub-Divisional Magistrates, State labour department and police.

62 of them were working in lac factories in LNJP colony in the Daryaganj police station premises making various items like photo and mirror frames with small bangle pieces, lac embroidered heels for sandals, bangles and other fancy items. They were from Katihar district of Bihar. Their usual day started in the morning at 10 and they would continue to work well into the mid-night until 2AM. The rest were engaged in zari embroidery and ball bearing units in Lahori Gate. They hailed from Motihari district of Bihar and Bijnour district of Uttar Pradesh. None of the children was paid anything. These children were trafficked from their villages by the agents and employers after luring their parents with money as little as Rs 1000-Rs 3000. As against this money, these children were sent to work by their parents. Makhdum’s bright, large eyes peer at you, when he says- “Salim (the employer) paid my father a little extra money (Rs 3000 in all) as my mother was ill. Now, I am working here to pay that money off. Most of the children had been working for the past 3 months to 3 years.

Spread in a large slum area with very narrow lanes, conducting this raid was a logistical nightmare. Many homes where children worked on the higher floors did not even have proper stairs. 12 year old Tayyab said that they slept in the same room as they worked in. They also ate in the same room. “Each room had 8-10 children in it. The children were bare foot and did not even have any warm clothing to protect them from the harsh winter.

“Scattered and tiny operations like these are not a complete solution to stem the fast growing influx of poor and helpless children in the Capital’s labour market. Until and unless the administration takes the bold initiative in launching rigorous and widespread combing operations and takes punitive action against the agents, employers and accompaniments, this menace will continue.” says Kailash Satyarthi, the renowned child rights activist who accompanied the raid team.

The SDM Daryaganj, Mr. N K Sharma said - “All children would be provided with rehabilitation under the Bonded Labour System (Abolition) Act, 1976, under which, they are entitled to a rehabilitation package of Rs 20000 and the provision to benefit from Government schemes like housing on a priority basis, besides enrolment in  NCLP school of all these children.

”The chairperson of BBA, R.S. Chaurasia and senior leaders including the organisations National Secretaries, Rakesh Senger and Bhuwan Ribhu led the operations.

The main objective of the India Action Week being organized by Bachpan Bachao Andolan along with its partners in Bihar, Jharkhand, New Delhi, Madhya Pradesh, Rajasthan of India in the first week of February (from 1st to 7th February), is to rescue trafficked children from roadside eateries, restaurants etc and also make arrangements for their rehabilitation.

The event also aims at pressurizing the Labour Department and other governmental authorities to implement laws and penalize the employers who exploit these children. The event will further try to sensitize the authorities to the importance of the cause of Child Labour. The first step in this process was taken by BBA activist, Shri Raghvendra in Madhya Pradesh who wrote a letter to the Governmental authority in the district of Mandsaur, about the inefficiency of the Child Welfare Committees of the State who don’t hold any meetings or take action against the problem of child labour. The collector of the District to immediate action and released a circular whereby the Committees were ordered to hold regular meetings and also be actively involved in the India Action Week being organized by Bachpan Bachao Andolan and its regional counterparts. Workforces for the same purpose have been made during a meeting of the committees on 28 January 2008.

The activities which will be undertaken during the week will be carrying out big raids in various hazardous industries and rescue as many children as possible and also book the employers without delay by imposing the stipulated fine and registering an FIR. Attempts will be made to get Release Certificates issued for the rescued children under the Bonded Labour Systems (Abolition) Act, 1976, as soon as possible so that the children are entitled to Rehabilitation benefits.

Arrangements for the rehabilitation of the rescued children will be made by collaborating with Rotary Club, Lions Club, State owned Shelter homes and various religious institutions. These institutions will help accommodate and provide food and other basic amenities to the children immediately after the rescue till the children can be repatriated and rehabilitated.

Other activities and programs which will be organized would be formation of human chains by school going children, rescued child labourers etc. to demand education for all and subsequently a petition would be charted out and submitted to the state or district authority. Post cards promoting the elimination of child labour will also be signed and posted to the Labour Department in the states in large numbers. Innovative means like Street Plays, Cycle rallies, screening of relevant films/ documentaries and signature campaigns will also be used to spread awareness about  the issue of Child Labour among people.

The India Action Week and all those involved with it hope to make a difference in the current state of children in society by coming together and taking affirmative action and also spread awareness about the cause alongside. BBA hopes to organize many other such events to finally achieve a Child Labour Free Society.
